What is the problem here? MS has essentially waived any patent claims
to their invention (C# and .Net) in order to get it standardized. The
only people who have to request a "license" are the people
implementing the standard (if that's even necessary). So, the people
creating Mono (i.e. Novell) are the ones on the hook, not you.

To put it simply: Mono _is_ Free Open Source Software.
