Gents,

I appreciate the feedback, I really do. It’s my first shot at a job description, so I appreciate the feedback and will incorporate your feedback into the position description. Based on your feedback, I have inquired with our Accountants to make certain we are in compliance of all tax laws, as we certainly are not looking to get around any state or federal laws by utilizing a 1099 position. I really appreciate you pointing that out, we’ll get it fixed and hired appropriately.

For the pay rate item, I agree, $20 per hour would be for an entry level Linux Admin. Honestly, I thought about calling this a Junior position, but frankly, I think the name is a little condescending (no offense to anyone with that current title, it’s just my personal feeling). We are a very fair company, and certainly do not find any satisfaction in under paying someone just so they can have a job with us temporarily while they find their next position. If the experience warrants it, we are happy to pay market rates for the position. The underlying position is for an entry to mid-level position that wants to be in a very active technology environment.

We expressed in the job description that it would be impossible to list all the skills, but we listed general skills and qualifications the candidate should have or should be striving to achieve.

Again, I am a very fair person, and am looking for someone with a base level of knowledge, but also someone that wants to learn and be challenged by new technologies. I found it very difficult to communicate in a job description what you need for qualifications, along with setting expectations of a very dynamic environment that will require consistent skill improvement. All we are trying to say is that every day is a challenge, we deal with new technology or at least different technology challenges each day. In the job description, I am just trying to be fair by listing as many of those that I can think of, so someone can decide if that’s the type of environment they would want to work in. In doing so, we probably overstated qualifications for the position, but we find that we can sort through that during the interviewing process.

Again, your feedback has been very good, and I sent it to our accountant to review and make certain we hire properly (whether it’s 1099 or W2), we’ll get that fixed to be in compliance. I appreciate that information, as I wouldn’t have known of that risk or issue. Thanks again.

Regards,

Mark Scully

also $20/hr on 1099 is an effective employee pay rate of less than $10/hr. An administrative assistant fresh out of college with no experience makes better (Emory University $16/hr plus full benefits package). This position requires at least 5 years experience in a highly technical field.

Using a 1099 status when what you have is an "employee" could be considered tax evasion and avoidance of paying unemployment insurance.

If a 1099 contractor was to file for unemployment it is very likely that GA would rule in their favor. Your company would have to pay that claim and will ALSO have to pay all the premiums that you had not paid while they were employed.
