Being that the user controls Android, it's easy to work around that. 
They just do not ship the stock Android firmware with support for 
tethering.  Once you root it, and install CyanogenMod, you can very 
easily tether over either WiFi or USB.

That said, I rather suspect that it's one of those sorts of things that 
they will only enforce if you do something like transfer excessive 
bandwidth and they can prove that you tethered to do so.  I suspect that 
their primary motivation is to prevent people from using T-Mobile as 
their primary ISP.  (Indeed, I could not, it's simply too slow for the 
amount of transfer I need in my time requirements.)
