The criteria under which the warrant was granted certainly does have
4th amendment ramifications. The fact that it was Linux is fairly
irrelevant, they'd have still gone after the dude if he was a windows
user. And that's why I feel this discussion isn't really cogent for
this venue. Using the presence of Linux as a pretext for what is,
essentially, a civil rights issue is not much different than using the
presence of Linux as a pretext for search and seizure.
I find it more than a little hypocritical to rail against a type of
behavior on one hand, while perpetuating it on the other.
