Maybe, maybe not. There are facts in this case that SCO is never gonna
be able to explain. For instance, How is SCO going to explain their
involvement in the development of Linux? After all, they have
contributed programmer resources to Linux projects that were gpl'ed,
provided proprietary information to other, non SCO companies and
individuals regarding SCO technology even when they knew it would be
used to produce gpl'ed code (To provide compatibility and have a hand in
the direction a project takes...) and the most glaring fact of all: They
willingly participated in the distribution of a Linux distribution. Both
before the Caldera (At least 1-1/2 years) merger and after.

Their willingness to participate in the distribution of Linux is
absolutely damning. Further, during this time, they did deals with SuSE,
RedHat and Mandrake with full knowledge of what they claim in the
lawsuit. There is no explanation that can be provided for this that
could ever approach plausible.
