Yes. As Ricker alredy mentioned, Tux is GPL'ed.
Furthermore, Tux 1.0 and Tux 2.0 are very different beasts. Just about
every performance enhancement that was part of Tux 1.0 is now part of
the mainstream 2.4.x kernel itself -- including things like zero-copy
TCP networking, and CPU affinity enhancements. Tux 2.0 has very little
kernel-mode code that is not part of the generic kernel.
This is why Apache benchmarks much faster with 2.4.x vs 2.2.x -- a
more than 2x performance increase -- on lesser hardware!
